This Privacy Policy explains how Lengers Yachts (“we”, “us”) collects and uses personal data through our websites (including lengersyachts.com) and through our other business dealings (phone, email, in-person contact). We act as the data controller for this processing under the EU General Data Protection Regulation (GDPR).

1. Information we collect

Information you provide via our website:

  • Contact and inquiry forms: name, email address, country, message and the yacht you are interested in.
  • Brochure downloads: name and email address used to unlock the brochure.
  • Newsletter sign-ups: email address.
  • Any additional information you choose to share with us in a message.

Information collected automatically:

  • Technical data about the browser or device you use to access the site.
  • How you use the site: pages visited, referrer, approximate location derived from IP address, and interaction events. This data is only collected once you accept analytics/marketing cookies (see our Cookie Policy).

Information collected through business contact:

  • Details of buyers, sellers and their representatives needed to negotiate and execute a sale or purchase of a yacht (identity details, price, payment details, requested options, delivery date and place).
  • Details of suppliers and other business partners needed to carry out our commercial relationship.

2. How we use your information

  • To respond to inquiries, questions and complaints.
  • To perform contracts we enter into with you.
  • To send you information about our yachts, services or events when you have opted in.
  • To notify you about material updates to our website.
  • To analyse usage of the site so we can improve content, performance and user experience.
  • To present the site in the most effective way for your device.
  • To detect and prevent misuse, fraud or abuse of our services.

3. Legal bases

We only process personal data where we have a legal basis under article 6 GDPR:

  • Contract — to negotiate, conclude and perform a sale, purchase or service agreement.
  • Consent — for newsletters, analytics/marketing cookies and embedded third-party content such as YouTube.
  • Legitimate interest — to answer inquiries, to secure our systems and to improve our services, balanced against your rights.
  • Legal obligation — to comply with tax, accounting, anti-money-laundering and other statutory duties.

4. Sharing and processors

We do not sell your personal data. We share it only with parties that help us operate the website and our business, or where we are legally required to do so. Current processors and third parties include:

  • HubSpot — CRM, marketing automation and website analytics (loaded only after cookie consent).
  • Google / YouTube — embedded videos on model pages (loaded only after cookie consent).
  • Supabase — hosting of inquiry submissions and administrative back-end.
  • Google Firebase (Firestore & Storage) — hosting of yacht listings and imagery.
  • Cloudflare — content delivery, DDoS protection and edge caching.
  • Email delivery providers — to send transactional emails such as inquiry notifications and brochure links.
  • Group entities and professional advisers — where necessary to execute a sale, deliver a yacht or comply with the law.
  • Public authorities — where disclosure is required by law or court order.

5. International transfers

Some of our processors (in particular Google, HubSpot and Cloudflare) may process personal data outside the European Economic Area. Where that happens, transfers are protected by the European Commission’s Standard Contractual Clauses or an adequacy decision.

6. Retention

We keep personal data no longer than necessary for the purposes for which we collected it. In particular:

  • Website inquiries are kept for as long as needed to follow up on the request, and are then archived or deleted.
  • Sales records (including personal data of the parties involved) are retained for at least five years after the sale for after-sales support, warranty and dispute resolution, and longer where required by tax or accounting law.
  • Newsletter subscriptions are kept until you unsubscribe.

7. Security

We take appropriate technical and organisational measures to protect personal data against loss, misuse and unauthorised access. This includes encrypted transport (HTTPS), access controls on our back-end systems and a limited number of employees with access to personal data.

8. Your rights

Under the GDPR you have the right to:

  • Access the personal data we hold about you.
  • Ask us to correct inaccurate or incomplete data.
  • Ask us to erase your data.
  • Ask us to restrict or object to certain processing.
  • Receive a copy of your data in a portable electronic format.
  • Withdraw consent at any time, without affecting past processing.
  • Lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).
